Legal Question in Family Law in California
I have guardianship of my 18 mo.old g-son while both parents are serving time and while the mother stays in constant contact via letters pics and calls with the baby the father has shown no interest in his son at all.The father gets out first and how can I request a reunification term of at least 6 mos.before giving the baby over to him?4 mos.b4 going to jail he signed off his legal rights to his now ex sister in law,we went thru a long expensive court ordeal once and cant afford it again yet we fear for our g-babys safety and well being once he is rreleased Also is it possible to transfer the case from one county where this all took place to the county in which we have been residents of all our lives?

If you have a court ordered guardianship then you have control of the situation. Neither father nor mother have the right to make decisions regarding your grandson. The parents would have to convince the court that the guardianship should be terminated before their right to make decisions about your grandson. You may be able to move the guardianship to the county in which the child presently resides. Do not allow father to take the grandson without a court order. Seek the advice of an attorney before allowing either parent to take your grandson.
