Legal Question in Family Law in California
Hello
My child custody and support case was just closed out 2 weeks back. When I first interviewed with my lawyer he quoted me a 7500 max for my case. I have paid in 7400, so I was surprised to see my final bill with a balance still owing of 3500, in addition to a new fee of 750 that needs to be added in order for him to prepare my final custody and support orders. He will not give me my orders until the balance is paid in full. I offered to send him 750 to prepare the docs and 875 a month over 4 months to pay off my balance and have not received a reply.
Can he doe this legally?
Is there another way for me to get my final set of court documents?
Thanks, Diana

If you have a billing fee dispute with your former lawyer then you should speak with the local bar association or the state bar to see if they might help you resolve the billing matter. You should always see if a compromise can be able to reach before doing any legal matters. It sounds like you are doing the right thing by trying to work out a compromise with your attorney.
For self represented individuals you can consult with the family law facilitator self help center at your local court house.
As always please consult a local attorney prior to taking legal action. Good luck. Also please check out my Santa Clara County Family Lawyer blog.
