Legal Question in Family Law in California
My husband has been paying child support to his ex-wife bi-weekly. We recently received notice that since July 2012 she had applied for aid and he was supposed to be paying the department of child support rather than paying her directly because they were giving her money for child support. Now we owe back up child support to the department. My husband already spoke to the department and submitted proof that he has been paying child support to her. According to everything she filed in court, she is not working, but we know that she is. Now, we recently had another baby, we have a total of 3 in our marriage and we have my step sons 50% of the time (custody is 50/50 for them). Would my husband be able to file so that child support can go down?

Most likely. This definitely sounds like something worth taking to the court to have sorted out and the correct amount determined.
