Legal Question in Family Law in California

Mortgages and Property

I have a written contract signed by my husband and myself in which he agreed to pay off a HELOC on house #1, in turn I agreed to give him house #2 (title/loan, all). He paid off the HELOC, I legally gave him house #2, then he charged $36,000 on the HELOC to house #1 prior to me refinancing it. So, I lost house #2 and cannot afford house #1 mortgage(s) alone. The divorce has been filed but trial is still pending. What can I do?

The issues are too complex to give you an answer that has any credibility. I suggest that you talk to an

attorney so that he can obtain all of the relevant facts. It really sounds like you need an attorney because someone must review the contract and argue its legal meaning to the court. You haven't done real well without an attorney so far, so you should learn from that lesson. Good Luck, Pat McCrary
