move out order

my x boyfriend and I have a 4yo child together, he lives with me in my house which I solely own, I have filed to establish a custody order and I have also requested a ''move out order'' in the same paperwork - he is unemployed and stays home to care for our child because he didnt want the child to go to daycare, he has never helped pay for the mortgage or any of the bills - the household has been a hostile environment and we have loud arguments every day and I cannot take it anymore which is why I filed a move out order - when is he supposed to move out? on the court date? the judge will approve for him to move out right?''

You should consult with an attorney regarding the facts in your case. The courts often favor the parent that is the primary care giver. Enrolling your child in a day care or pre-school may be a good course of action.
