Legal Question in Family Law in California

moveaway

I have been offered and have accepted a new job out of California. I need to go against the Court order to not take my child out of my county in California. However, my child's mother moved out of state a few years ago. We have had joint custody, but our child has resided primarily with me. My moving would not affect her visitation with our child at all, but the Court has scheduled mediation and a hearing in three and four months respectively, and I need to report to my new job in a couple weeks. I--name removed--t want to be arrested, but she has already filed a motion for abduction. What do I do?

Re: moveaway

You should seek an ex parte order allowing you to move out of the state. In your declaration to support the order you would state facts showing that she has moved out of the state and if possible that it will be more economical for her to continue her visits. An attorney could review the facts with you and improve the probability of obtaining such an order.
