Palimony to abusive husband with resident visa?
My friend is in an abusive marriage and is afraid to divorce her husband
because she doesn't want to pay palimony and is afraid of retaliation. Here
are the details:
They've been married just under 3 years
He has a resident visa
They live in California (West Hollywood)
She makes substantial money
He makes none (and refuses to work)
She has no photographs or any other proof of the abuse (other than what
would be considered heresay)
Are her concerns valid? Would her husband, who doesn't yet have permanent
resident status, be deported if they divorced?

She should contact an attorney and discuss her case. In most cases involving domestic violence restraining orders there are only two witnesses, the spouses. She should not continue to endure an abusive relationship just to avoid paying spousal support. The court would order him to seek employment.
