Legal Question in Family Law in California

Parental Rights Question

I am filing divorce in a few days. Currently my spouse's son who is 18 is in a state ordered mental facility for battery with great bodily injury on his father. My husband intends to take our minor child who is 10 mos to weekly therapy sessions at the mental facility. I fear my childs safety as he has attached his father several times and more recently his mother a few weeks ago. Both the mother and father will attend the therapy. I do not want my minor child to attend but my spouse is insisiting ''its his child too'' and he can do whatever he wants. How do I insure my minor child is not allowed in these sessions.

Re: Parental Rights Question

You need to file for custody and visitation orders at the same time you file for divorce. If the therapy sessions will occur very soon, you may have a basis to obtain an immediate hearing date or an order shortening time for hearing. I urge you to obtain an attorney in order to take the right steps to protect your child.
