Legal Question in Family Law in California

I have a pending criminal domestic case open, I was falsely accused by my soon to be ex wife, she starts nursing school & wants to file paperwork at family court so we both share 50/50 custody of our kids. Should I wait till criminal case is closed before dealing with custody case ? Or does it matter?

If she is agreeable to the shared parenting arrangement with your pending criminal charges, it's to your advantage to reduce the parenting agreement to a court order in the event your ex decides to change her mind about this parenting arrangement later.
