Legal Question in Family Law in California

I'm not sure I understand your question. As I understand it the couple was living together. One of them wants a divorce and moves out of the residence. The question is whether the other member of the couple has a right to move in with the person who left the residence, wanting a divorce. In other words the couple may be considered "separated." If this is the case the second person has no "right" to move in with the person who left the marital home.

I'm not sure what is confusing bout the question. The answer is "no."
