Legal Question in Family Law in California

Proposed judgment for Child Support

I received a proposed judgment for child support. The monthly figures listed for my expenses are all incorrect or left blank. I completed an income and expense form and it was not included in the monthly figures. The order is for $781.00/month which I cannot afford. The custodial parent has listed $1000.00/month of child care which I believe she is not paying. Should I try to pay this amount or wait until the order is corrected. Your assistance is greatly appreciated.

It sounds like you are dealing with the Department of Child Support Services. You should consult with an attorney who can review the documents and your situation to determine wha the amount for appropriate child support. There is a formula that calculates your takehome pay and the amount of time that you spend with the child. Good Luck, Pat McCrary

You should get a lawyer. You are dealing with Child Support Services, and you don't want to mess it up, believe me. You need to file an answer objecting to the proposed judgment ($781 a month in child support) or it will become the order. FYI: Child support is based upon the relative income of the parties and percentage of time share with the child(ren).
