Legal Question in Family Law in California

reading spouse's emails

My spouse and I are facing a divorce. He cheated on me but now denying that. Is it legal to read his email conversations, and use them as evidence in California, if he in the past provided me with his password?

In a general sense, California is a no fault divorce state, and a party's alleged infidelity is a non-issue.

For a specific opinion regarding your individual circumstances, I suggest that you consult with an experienced family law lawyer. Experience is not expensive, it's priceless!

There is nothing illegal about reading his e-mails. Whether that information is relevant in court is another question. Good Luck, Pat McCrary
