Legal Question in Family Law in California

Separation and financial responsibility

A year and a half ago, after 5 yrs of marriage, my husband had an affair and left me--name removed--I basically supported him and put him through school. There has been no talk of divorce as I do not agree with it.

1. Am I responsible for the school loans he incurred?

2. Am I responsible for any debt he incurred after he moved out?

3. If I take him off my health insurance am I responsbile for his medical bills?

4. If I leave him on my health insurance am I responsible for his medical bills?

5. How can I protect myself finacially in this time?

Re: Separation and financial responsibility

The answers to one, two and four are no, you are not responsible for his student loans or post-separation debts, including medical debts. As to taking him off of your insurance, you should probably talk to an attorney, you probably could at this time, however, as soon as you file a dissolution of marriage there is a restraining order preventing you from making that change. To protect yourself you need to talk to an experienced family law attorney and file for a dissolution of your marriage. Good Luck, Pat McCrary
