Shared Cars

My soon to be ex husband got me a car 9 months ago, and got himself a car as well (both $615 per month) He has always paid the car payment becuase I cannot afford it. Now that we are getting a divorce he wants me to pay for it, which I would if it wasn't half my paycheck and I didn't have two kids to take care of. The car I'm driving has his name as the owner on it. The car he is driving has him as the primary and me as the cosigner. He said that he is going to come get my car and turn the one lease in that has both of our names on it. We had to file for BK a year ago becuase of his gambling problems and now he is trying to screw up my credit again. Is there anything I can do legally here? Also, He doesn't have a job and I work full time and take care of our two kids.

Ask the court to order him to give you the car and order him to continue to make the payments on it. Ask for spousal support as well. There's got to be some kind of deal that can be made.

It's fair in a divorce that the parties evenly split the debt and the assets. However, you don't make as much money as he does and you have primary custody. I would go to the court with this issue.
