Legal Question in Family Law in California

My son is 16 and lives with his mother, he wants to move in with me and he has told her. Do I need to have a court order before he moves in or can he move in first? We live in California.

Provided that there is already a court order placing your son in the custody of his mother, you WILL need a court order to modify the custody arrangement. If you and your son's mother agree to the change in custody, you can write down your stipulation (agreement) and submit it to the Judge for signature.
