Legal Question in Family Law in California

New spouse and child support

I am involved with a man who is paying monthly child support to his childrens' mother. If we get married, will my income be affected. Does the mother have a right to include my income in order to get a higher child support payment? Or is the father's income only affected? Thanks for your help with this.

Re: New spouse and child support

In California child support is generally determined by father's income, mom's income, the number of children and the amount of taxes paid by each parent. You income would be considered only to the extent that it influences the amount of taxes he pays on his income. However, any funds or property held in both of your names jointly would be subject to being attached to pay child support. You should discuss this with an attorney to determine what would be your best approach.
