Legal Question in Family Law in California

Where do I start in taking legal steps in a lawsuit. The first two are the most significant.

1. Family court Judge addmitted on the record he made a mistake when granting Ex parte orders to ex boyfriend who had no paternity. I want the city or county held responsible for such a serious mistake. The guy could have been a complete stranger for all the judge knew

2. I want to sue the ex for pain and suffering and unlawfully taking my daughter.

3. Petitioners attorney who lied to the court appologized about not having the Declaration of paternity that never exsisted but the judge accepted that.

I would prefer to not be advised to seek out a lawyer. That goes without saying. I need to now what type of lawyer. I dont know If the two separate issues would require the same kind.

Your question is confusing, did your boyfriend claim paternity when he was not the father? Are you getting child support now from the biological father?

Unfortunately the judge, city and county are completely immune from being sued for this. I would recommend suing the boyfriend and his attorney together. There are a number of causes of action that I can think of that might apply. You say you don't want to be told to find an attorney, but seriously, I have to tell you that. You will waste your time and lose your case if you sue a lawyer by yourself. Any good general trial litigation attorney could handle your case. If you are in greater San Francisco Bay Area, out to and including Sacramento, I may be able to help you. Otherwise, contact the attorney referral service of your local county bar association.
