Child custody battles can be very complex. If there are false allegations you should make sure your document the truth with evidence which shows tha the allegations are false. I am not sure at what stage of the litigation you are at, but you should probably consult with a local attorney or the self help center in your court house for advice on how to present yourself in court and what needs to be done to put your case in the best light. The standard the court will examine is what is the best interests of the child. So you will need to convince the court that your household and the schedule you propose is in the childs best interests.

For self represented individuals you can consult with the family law facilitator self help center at your local court house.

As always please consult a local attorney prior to taking legal action. Good luck. Also please check out my Santa Clara County Family Lawyer blog.
