Legal Question in Family Law in California

My three year old's father and I were never a couple. He has notified me that he is taking child on a one week trip (which is permitted under our orders) but refuses to tell me where he is taking child. Isn't he required to tell me where my child will be for one week? Thank you.

Generally yes, as joint parents you are required to keep each other informed of the whereabouts of your child. Now enforcing that is difficult, especially if it just happens once. I would ask him in writing to let you know the whereabouts of your child prior to the vacation. If he does not then I would take it up at a future court date to receive an order from the court.

For self represented individuals you can consult with the family law facilitator self help center at your local court house.

As always please consult a local attorney prior to taking legal action. Good luck. Also please check out my Santa Clara County Family Lawyer blog.

If it is not in a court order, he has no duty to inform you.
