Legal Question in Medical Leave in California
Disability vs FMLA employer not offering sdi only FMLA
I am an employee (Manager) of a large department store I have been working for over 5 years and never been written up once. In the last three months I have been written up twice for things that have been considered okay before. The only thing that changed was my boss.I have heard that they hired a new manager for my position and he comes from my bosses old store. Since all this has been happening he has been pressuring me and harrasing me with calls and demining comments. With all the pressure I have been doing more work that usual 50+ hours a week lifting and cleaning, in the process I hurt a nerve in my back. I went to the doctor and he gave me no work for 14 days in return my company faxed me FMLA paper work. Is this correct sould I have not been put on disability first. What is this company doing? any suggestions would be greatly appreciated. What is the difference between FMLA & SDI?

If the company has medical leave, you should have to exhaust it first before FMLA, if FMLA applies. Try to work it out with Personnel first, then hire an attorney if you have to.
