Family Medical Leave Designation

Is an employer required to designate family medical leave when the employee has provided certification for ten days that states employee unable to work. If the employer fails to designate leave, and never sends Family Medical Leave Information to Plaintiff. Employee is then terminated for job abandonment.

Normal medical leave is not the same as FMLA. If you actually qualify for FMLA, then you should advise and request to employer provide it. If they are aware that you would qualify for it, then they are supposed to advise you of availability.
