Legal Question in Medical Leave in California

fmla does it cover me

I was off for a month due to depression and change of meds..My physician wrote a note for all the days I had off. The first day I had off I called in that I was going to be late due to fmla. I did not show up for work due to severe anxiety..I called later that evening and said i would provide doctors note to the company. They are saying that the first day i was off was not covered and are writing me up and being put on probation for this even though I have a doctors note. Can they do this?

They should accept the first day the same as the others, as long as your dr certified it as part of the leave. If they won't correct and remove the discipline, contact me to discuss your options and cost.
