IF, IF, you are on title to bank accounts, house or car as 'joint tenants, then it becomes your property. Without a will or trust, all other property has to be probated, but it is simplified if not a large estate. A typical 'house, car, bank account' estate is small and easy. If you need legal help in this, feel free to contact me.

I don't understand your question. If your husband passes away, you are a widow, and his propert passes as directed in his will or by intestate succession. Since he is dead, he will be unable to marry a "new wife." Or is this person your EX-husband and you are still referring to him as your husband.

Re: marriage/Death

I understood your question. You recently married your now-deceased husband. If the property had been purchased during your marriage, then it might be community property. If it had been purchased prior and there are children, the law provides for intestate succession. If you're concerned about it, I suggest you bring everything you can find about the house to a lawyer in your community ASAP.
