Legal Question in Federal Tort Claims in California

Federal - Subpoena Out of State?,Top on Award?, Power of Attorney

Federal Court Case, approx. 15 defendants

1. If I give power of attorney to another person (not a lawyer) can they conduct the case pro-se in my place?

2. Can I bring charges of perjury, falsification of evidence in the Federal court or must it be Civil Rights violations only?

3. Can people be subpoened from outside of the state where the Federal case is being held and be compelled to appear?

4. Can each defendant be sued individuially according to their part in the offenses & is there a top dollar figure per individual or a top dollar figure cumulatively for all parties in the case?

Re: Federal - Subpoena Out of State?,Top on Award?, Power of Attorney

1. Of course not.

2. You can ask the prosecutor to do so criminally, or file civil suit, as appropriately supported by admissable evidence.

3. No.

4. All claims must be brought in one suit, and it doesn't matter how much you ask for over the court's minimum limit.

Now, since you didn't know this basic procedural information, do you believe you can successfully handle legal matters that attorneys have difficulty with in Federal Court, where procedural violations can result in serious monetary and case dispositive sanctions? If you believe you have a legitimate case, hire experienced counsel to avoid serious problems and/or loss of the case through errors or omissions. Contact me if interested in doing it right.
