Legal Question in Civil Litigation in California

Borrowed car accident

A roommate lent me his vehicle to got work as he had done in the past. Un-known to me he didn't have enough insurance and I got in a 1 car no-fault accident. The vehicle was totaled (as judged by the tow guy). Now he wants me to replace this vehicle which he was planning on giving to my wife at a value that seems very high. do I owe him?

Re: Borrowed car accident

I'm sorry. You wreck his car and you ask if you owe him anything? Yes, the value of the car, for which he could sue you.

Re: Borrowed car accident

I guess it depends on what caused the accident -- i.e. a road hazard that you couldn't control, your inattention, or a vehicle defect. If the second cause, definitely. If a vehicle defect, probably not. If the first, maybe. If you have insurance, report it to your carrier.
