Legal Question in Civil Litigation in California
My boyfriend is being sued for unvoluntarily returning merchandize after not making his payments. I was never involved and never signed anything. Now, I am being sued as well for being in the house when they came to get the television. I never even saw the person, but they are saying they heard my boyfriend say my name and that's the grounds they are sueing me on. Is this legal?

They can't successfully sue you if you did not sign the contract nor damage the goods.

It sounds like they're suing you for conversion -- the unlawful interference with someone's right to possession of property. However, if they're making a simple breach of agreement case into conversion, they have a big hill to climb. You should get yourself an attorney in your area to handle this for you, since the consequences could be serious. I agree with my friend that you shouldn't let them bully you.
If they are actually suing you, that means serving you with a Summons and Complaint that you have to legally Answer or respond to, then your attorney will determine if there are grounds for a motion to dismiss you from the case, as it seems. If they are simply blowing smoke, ignore it unless served.
