Legal Question in Civil Litigation in California

Car stolen?

I was storing my car at a friends house. My so called friend lied to me and said that the police had questioned him about my car and said it wass on a hot list for repo and to avoid having the homeowner arrested, the police told him to put my car on the street and they would pick it up. He never contacted me. I found out a month later what happened. I immediately contacted the police and my finance co. The police have no idea what he is talking about and would never have given such advice and my finance co does not have my car. Word of mouth has it that this so called friend gave or sold my car to a drug dealor who is currently driving my car. This drug dealor has even been detained in my car for 3 hours by police due to expired registration and fake tags they placed on car. The police let the drug dealor go with my car!! I have attempted to report my car stolen only to be told that I can not. I need help!! I want to sue the friend who sold my car and I am frustrated with the lack of help from the police. My car was 2007 Hyundai Tiburon GT, I owe nearly 30,000. How much can I sue for and who do I sue?

Re: Car stolen?

You can sue your 'friend' for fraud and conversion. Does your friend have any assets or money, though, to pay a judgment if you were to get one? If not, even though legally you may have a good case, you could end up recovering nothing.

Re: Car stolen?

Report the car stolen to the police and your insurance company, and prepare to be sued by the lender if you can't demonstrate evidence of what you claim. Don't file a 'false report', doing so will get a person arrested. You could try to sue the 'friend'. Good luck.
