Legal Question in Civil Litigation in California
CLARIFY my question- A rant that got out of control- thanks for the response
First I did get council, since the company involved the police and have filed a restraining order.
Unfortunely from there its got way out of hand. The company in question in a mult $100 million company. Because I said I ''would kick his A** and he was dead if he did not stop stealing from shareholders or resign'' He is pushing the threat. There council said if I come up with $40,000 they would stop the restraining order and drop the issue. Otherwise he will sue me civily for the $40,000.
I lost 10's of thousands and was angry. Can the words your dead cost me $40,000? I have no record, not even a parking ticket. Its just a stressfull financial times. And when the company flat out told me ''we don't care about your losses....'' I was pissed.
My current council is not a civil lawyer and needed more help. That is all

Thanks for providing more information. It sounds like you need an attorney to nip this in the bud before it gets any further out of control.
Unfortunately, this looks like it may cost you either way, but it almost always better (i.e., cheaper) to settle before a suit is filed. If they are willing to "drop the restraining order" for $40,000 payment, it doesn't sound like actually consider you a legitimate threat. This undermines their position, no?
I would attempt to settle with them for an apology and a promise never to contact them.

If your lawyer doesn't handle these kind of matters, why did you hire him? Get a new lawyer that does.
Yes, the company can claim anything they like, and can try to prove it and collect damages and penalties from you. I'm surprised they didn't try to have you arrested and charged with 'terror threat'; I've seen that happen. Or is it that they did file criminal charges already, and your criminal lawyer told you to get a civil litigation attorney?
