Legal Question in Civil Litigation in California

Customers who deceive in order to sue.

Is there a law protecting contractors from customers who allow us to begin work in a home that they know contains asbestos, then after the work is completed, sue us for asbestos exposure? The customer had remodeled previously and was aware of the asbestos, but never told our estimator or anyone else, until the installer went to the home and began to make the first ceiling cut. We did send a sample to a lab, and the amount is so small that it isn't considered a danger by industry standards. They allowed us to finish the install, being very much against cutting through the wall instead of the ceiling (the ceiling is the source of the asbestos) and after the install was done and the unit was running, they filed a claim against us. Isn't that entrapment or something?

Re: Customers who deceive in order to sue.

Its not entrapment in the normal use of the word, but it offers a defense to you against their suit. Your attorney should be using that, and I assume you have insurance that provides you with an attorney. If you need to hire counsel, call if interested. 714-960-7584
