Legal Question in Civil Litigation in California
My next door neighbor's had two and now they have one and they go out to the patio and pis and poop and they do not wash or clean it properly some days they do not clean it for days, even I wrote to my association numerous times and send thempictures but I cannot get help from them. Smell is awfull. Like today (Saturday) the dog had pooped and pised from friday is still in their patio and they will clean it when they have somone over or when they feel like. I cannot enjoy my patio. It smells so much when I come home, I have to close my nose to get inside my home. I moved to my town home in 2005 and year later they moved since than I have been having this problem. When they decide to wash they wash to the street and you can see all that dog stuff on to the street. I cannot enjoy my patio when I have vistors becuase of the smell. Please help as to what I should do? I am very tired and frustrated. Please help.

Call the Health Dept and the police and follow up with whatever agency they send you to.
You can sue the neighbor for nuisance and get an order that they stop. If there is a violation of the CC&R's, By Laws, or other rules and regulations governing the HOA, you can also get an order that the HOA enforce their rules.
