Legal Question in Civil Litigation in California
Friend owes me money
My friend asked me if I could get a
car in my name which he would pay
off since he couldn't due to bad
credit. He said that he would pay off
the car within months since he was
doing well with business. I trusted
him and I did get a car in my name.
He made the first 3 payments. I tried
contacting him so he could pay the
fourth but he ignored my calls. I
ended up paying it with my own
money. I actually ended up paying
for three months of the car
payments. He eventually called me
and told me that he was having hard
times and that his cousin wanted to
take over the car payments and get
the car in his name. This never went
through. This friend of mine missed 6
monthly payments in one year. Can I
sue him for the money he owes and
what are my options about getting
the car out of my name because
there is still a lot owed and the
agreement was that he would pay off
the car. Can I sell the car and have
him be responsible for the difference
that is due on the loan. I feel like I
have been taken advantage of and I
want to clear myself of this horrible
situation.

Re: Friend owes me money
Sure, you can sue, but you'll have to speculate whether you'll ever get anything from the guy, judgment or not, to make that worthwhile. The car is in your name, thus is technically yours. IF you can get possession of the car without an altercation or getting arrested, you can sell it, which is the only way you're likely to get the LOAN 'out of your name', since to do that requires you pay off the loan.
