Legal Question in Civil Litigation in California

what do we do? we hired a lawyer ($20,000), she didn't do anything she said she would, gave nothing related to the case to the judge, people wrote supporting letters which judge had never seen, she recommended a psychological evaluation ($2000), the results were not given to anyone. didn't show for first court appearance and blamed her mother's cancer, didn't show at trial but sent an associate who knew nothing of the case. turns out, she had been disbarred one week prior without telling us, has done this to ten other people and uses fake names. she was professional looking and acting before we hired her. what do we do?

You should report this to the State Bar. That may seem redundant since she is already disbarred, but attorneys can apply for re-admission, and you want this in her record to go against her being readmitted. There is also the possibility that if she wants to be readmitted she will pay some restitution, which is an important factor in how the State Bar Court deals with discipline cases. Then you should also see about hiring an attorney to sue her for malpractice.

In addition to what my colleague suggests, you might still be able to salvage the case, depending on where it now stands. You should speak with a real lawyer immediately and be prepared to provide a brief synopsis of the procedural history of the case, first.

I would speak to a lawyer as advised by Mr. Cohen. I do agree with Mr. McCormick to the extent that she should be reported to the bar, but I suggest that you have the new attorney handle this, as his or her complaint may be more focused and specific, and trigger the appropriate response from the California State Bar. The new lawyer should be able to handle all three functions discussed in Mr. Cohen and Mr. McCormick's responses.
