Legal Question in Civil Litigation in California

limited civil judgement

I had to return my leased vehicle because I lost my company. I only had he vehicle for 6 months when I returned it and it was brand new. I returned the vehicle to the dealership on Oct. 2007 today I received a summons from a processor. What is going to happen, my husband and I have jobs but, we are still barley getting by. What will happen if I get a judgement. Will they try to garnish our wages. We are willing to make some kind of payment araingment, but it won't be much.

You're being sued. Negotiate a payment plan to avoid the litigation, if possible. If you wait til there is a default judgment against you, you have no remaining leverage.

You are most likely being sued for the difference in the value of the car from when you bought it to when you returned it(depreciation). My first suggestion would be to hire an attorney to answer the lawsuit or attempt to answer the complaint yourself-either way, don't ignore it.
