Neighbor vs. Neighbor

Our neighbor directly behind our home has just built a planter against the wood fence we share. When they water the plants, the run off is coming into our backyard and making our entire backyard muddy and wet. This is affecting the use of our yard. What steps do we take in possibly filing a suit to get them to correct the problem since talking to them is not working?

First try to resolve it privately [done], then advance to getting counsel to write them a demand letter, and last resort is to file suit. Since talking hasn't helped, contact me for legal help.
