Legal Question in Civil Litigation in California

Neighbor trying to have us kicked out-creating big problems

My neighbor thinks that my son slept with his daughter and has decided that we should be thrown out of the neighborhood. He has been talking to all of the rest of the neighborhood to get them to come together and have us thrown out for abatement (?). In order to accomplish this he constantly calls the police on us. The police don't seem to believe us and since he has started all of this he has turned us in for drugs, noise, guns, called CPS, and he stops the kids friends on their way over and tells them they shouldn't come over to the house and that we are bad people. What can we do to stop this?

Although difficult, because of concerns regarding Freedom of Speech, such repeated conduct, without the conviction or even a charge of any crime, would lead a judge to see this for what it is harrassment. It would, however, take an evidentiary heaing to get a restraining order.

You can sue but be prepared to have it cost you some serious money. If you are willing to pursue legal action you "may" obtain financial compensation to make it worthwhile, but you may not. Call an attorney if you want to pursue this.

you can try to get a restraining order, and you can sue him for slander and harassment. However, whether it would work to stop him, and whether it is worth doing considering the costs and fees, is something you need to discuss with a good attorney. You can contact me if interested.
