Legal Question in Civil Litigation in California

Phone Bill

I had my friend on my wirless phone account and she was making payments for her part of the bill then she wanted me to cancel her phone from my account in aug 06 and she now refuses to pay me back for the cancellation fee. so i just paid for it because she would not pay and i did not my phone to get turned off. i was wondering what i can do to get her to pay me back and if it involves court how much does it cost.

Re: Phone Bill

Depending on the cost of the cancellation fee, it might not be worth going to small claims court. Send her a certified, return-receipt letter (or have a lawyer do it for more clout). Then, if she doesn't pay, your only recourse would be small claims. Good luck!

Re: Phone Bill

This would be heard in a small claims court. I'm not sure what that cost, but I'm sure it's much cheaper than superior court which is now up to $320.00 to file.

The strength of your case relies on whether or not your friend was aware of the fee. If your friend was not advised that there was going to be a cancellation fee, then you may have some problems, but if you did advise her of the fee and she okayed the cancellation, then she may be on the hook for fee.

Good luck.
