Legal Question in Civil Litigation in California

power company liability for tranformer explosion

Our power provider's electrical transformer supplying power to our house exploded. A power spike from this explosion fried our DSL modem and our dishwasher's electronics. Is the power company liable for these damages to our house?

Re: power company liability for tranformer explosion

Courts have found that electric transmission is a product, and the product liability standard is applied. However, if a transformer exploded, there's a factual question about whether the "product" was defective. You should check with a lawyer in your area for a thorough review of the facts.

You can make a written 'claim for damages' promptly upon the power company, explaining what happened and listing your expenses you want paid. Their response will advise you of their position - whether they will pay, whether they say you have a right to recover, and what your appeal and right to sue are if they deny the claim. You also may have homeowners insurance that will pay it.
