Legal Question in Civil Litigation in California

Protecting a family legacy

My late father and uncle owned a race car in the 60's that was famous for its time, then they sold it. The new owners ran it under a different name for a few years, never the original name, graphics or color. There is a person who claims to own the race car now, in New York and he is planning on restoring it to the original race car. He plans on showing it t car shows and Nostalgic Races. Can I prevent him from using the original name of the race car or any likeness of its original fame, color, graphics, ect...

Re: Protecting a family legacy

probably not. It sounds like it might qualify as a trademark but once you stop using it in business you lose trademark protection.
