Legal Question in Civil Litigation in California

I currently purchased a car on September 2, 2011, and I missed my 1st payment to the finance company, and they had my car repo on October 24th. During the process of the repo company towing my car; my car was driven and the car broken down. I paid the finance company, and the repo company to pick up my car on October 27th, and that is when I found out the my car was not working. I tried to go through my insurance company and they will not cover my car because the engine was blown due to my car being driven to its max. I can't afford to get my car fixed, and I want everyone who is involved to pay for either getting my car fixed or give me my money back so I can get another car.

Please let me know what I can do or if someone can help me fight this. I have too many companies to go after where I don't believe I can fight this by myself.

Please help!!!

You don't make any sense at all. If your car was repossessed, and damaged during repossession, why are you asking your insurance company to pay for damages?

If the vehicle was damaged by the people who repossed it, you will need to submit a claim with their insurance company, or, file a lawsuit and name all of the people involved. However, if the vehicle is still in the possession of the lender and/or it's agent (the people that repossed the vehicle), and you still owe the missed payments, you are out of luck.

If you just purchased this car, then it should be under warranty. Get it reparired under the warranty. Alternatively, sue the repo company in small claims as I am sure the repairs won't be over $7500 which is the small claims max. As for your insurance rejecting the claim, it requires a review of your policy and is not that easy to answer in this forum.
