Legal Question in Civil Litigation in California

How do I remove an unwanted family member from my property and keep him off? I am an 86-year-old woman living on just my Social Security. My 65-year-old alcoholic nephew arrived uninvited 15 years ago and has been dwelling on my rural Riverside County, California property ever since. He receives 100% disability as a post-traumatic war vet, yet refuses to pay rent. He pays for only the groceries and utilities he chooses to pay and does some errands for me. Our relationship has always been "rocky." I have often told him to find another place to live but he has always refused to leave. Recently, his alcoholism, mental instability and outbursts have worsened and I cannot deal with him anymore. How do I proceed?

You could call the police and/or you could file for a civil restraining order or an eviction. I suggest you call the local Legal Aid office or the local Lawyer Referral Service and ask for low cost or free help.

It sounds like this may constitute elder abuse. Call your local DA's elder abuse unit or the police.
