Legal Question in Civil Litigation in California

Do I have to return Property

My problem is as follows: I had a livein boyfriend of 10 years, he cheated on me one night, I told him to leave, he got engaged a week later, married one month later, ''New'' woman got 1.2 carat diamond , 14 day cruise, I got nothing. I repeatly ask him to remove his things from my home, I finally put it all outside and wrote him to say, pick it up, or it will be stolen,, He finally did, Now he wants the washer and dryer, sofa, bed, he did purchase these items, but he lived here. Since I request him to remove items prior, isn't the remainder of items mine? He left 7/2/02. Now it is Sept 24/02, and all of a sudden he wants all the ''stuff'' he is threatening me with a law suit, I told him fine. I might add, during the time we lived together, he didnt pay anything toward the household for 8 of those 10 years, except groceries, last two years I requested $400.00 a month. What do you think I can do???

I would not do anything more. If he wants to sue you for his stuff, let him and then cross-complain for the monies he owes you for rent. He does owe for rent and the items left behind sound like good enough compensation. Good luck-Martin

Settle with the jerk, or get sued by the jerk if he is serious. Your problem is that you shacked up with and shared expenses with some guy without any legal protection the law gives married spouses. You have some rights under the law, but you are talking about a dispute over used appliances, not substantial equity in a house. It would cost more to have an attorney involved than it is worth, unless the jerk actually sues, which forces you to then hire someone to defend you or settle it quickly.
