sidewalk trash receptacle citation

I received in the mail a citation

for violation of San Francisco,

CA code MPC35a. Apparently

they found a sack of garbage

full of my discarded mail in this

sidwalk bin. I did not put it

there and they have no proof

to show I did. It was likely

from one of the many vagrants

going through my trash,

throwing in on the street, and

a neighbor putting it in the bin

the next morning.

What can I do to defend

myself?

Hello:

If the City/county of San Francisco ALLOWS a trial, request a trial. You will probably have to post the ticket price as bail first. If there is no live trial, then most likely you can have a trial by declaration or written argument. Either way, I suggest that you take pictures of the sidewalk area to show that others have trash out--try to get a picture with a vagrant taking the trash out of a recepticle. Good luck!

PS You must consider the value of your time vs. a day in court.
