my son a bought a car the guy said it would bre no problem passing smog but we came to find it is taking alot more to fix because it doesn't pass smog can we get our money back

California law requires that the seller must make sure the vehilce can pass the smog requirements. The seller did not comply with these terms implied in the sale so the contract can be voided by your son. He can return the car and get back the purchase price and all reasonable costs for trying to get the car smog approved. If your son is under the age of 18, he can not be bound by a contract and can also return the car for a full refund.
The seller is required to provide smog clearance. If he won't pay to fix the car, you may have to sue in small claims court.
