Legal Question in Civil Litigation in California

Truck Crashed Into Rear Vehicle At 45 MPH

My Husband and I where fully stopped at a red light when a truck crashed into the rear end at 45MPH in my new 2007 Honda Accord, I financed and only had for 8 Days. We both sustained body injuries and continue to see doctors. The Insurance declared the car to have 13,000.00 damage and to have it fixed. I left the vehicle at the body shop and the owner assured me that it would be just like coming out of the factory. After 45 days the auto body shop tells me its ready and when I saw the car I refused to take the car. the body is not lined and is noticable. I called my attorney and he said, to have them write everything down on a paper and take it somewhere else. And I said, how about if they can not fix it properly, again he said to take it somewhere else. I told him there has to be something he can do. I have to live with the injuries, pain, mental depression. I had to abanded my new business we had just started, my husband can not work. I took a lost on that as well. Now I have to pay 32,0000.00 on a car that I know has extensive damage and 449.00 mo payment. The man that caused this damage has great insurance and property. I sue for his assets for all the above damage? Please Help Thank You

Re: Truck Crashed Into Rear Vehicle At 45 MPH

You can contact the DMV about auto repairs and report the poor and probably dangerous repair to your vehicle. If the DMV cannot help then you will need to take your vehicle to a reliable repair shop for an evaluation of the quality and reliability of the repairs. If the wheel alignment is improper it can cause the vehicle to be unsafe. You may have to sue the repair shop for the improper repair of your car.
