Legal Question in Civil Litigation in California

Unauthorized population of private information

My ex boyfriend posted what he calls his autobiography on his myspace page. In it he gives my full name, email address, and the URL to my myspace page. Now I am getting a lot of emails and messages from people I dont know commenting, asking questions, and generally harassing me in regards to my ex. His autobiography, is for the most part true, but it still makes me look bad. I have not talked to him in over a year and did not consent to have my information reveled to the public. How can I get this stopped? Can I sue him for invasion of privacy? What kind of legal action can I take?

You could sue for invasion of privacy and infliction of emotional distress and seek and injunction to get him to take your address off the net. You might threaten to take him to small claims court if he does not comply.

Welcome to the real world of the web. Sure, you could sue him -- if he posted provably slanderous material or improperly invaded your privacy and caused you demonstrable emotional distress. That is, if you are prepared to spend time and money at risk. Unless he has substantial income or assets, what do you expect to achieve in the case other than paying a large bill for attorney fees and costs? Obtaining a restraining order might be possible as part of such suit, so that would justify legal action. First demand he correct the situation.
