Legal Question in Civil Litigation in California

Do my wife and myself have a wrongful death or negligence case?

my stepson was eighteen years old living with a couple in there home.they knew or should have known before inviting him to live with them that he had a history of suicide attempts. this couple departed for vacation and left a

loaded firearm/ handgun unsecured with no trigger locks or in a gun safe.

my stepson had knowledge of the location of said firearm and took it to the back yard of there residences and shot himself in the head with said unsecured firearm.

While it's likely to be a bitterly contested case with the insurance company, yes, you could go forward with a case for negligence on the facts given. Your wife should consult an attorney. Watch out for legal time limits.

It would be vigorously defended, of course, and to win you'll have to be able to prove they were actually negligent, based upon all the facts. There are firearms storage laws that may apply here to your advantage in proving negligence. The statute of limitations may be as little as one year, so don't delay. If serious about pursuing this, feel free to contact me to discuss your facts, rights and remedies.
