Legal Question in Civil Litigation in California

writ of execution

I have a judgement with a wage garnishment with a balance, the defendant has been terminated from employer but still owes a balance? I don't have any other info on defendant other than past employer. What can I do?

Re: writ of execution

Before hiring an investigator, you should try to find the guy by using the internet. There is alot of information out there to be found. Just type in name search, address search, people search, that kind of thing. If that doesn't work, then, you will need to hire an investigator. Make sure the person you hire is ex-police/FBI and is reasonably priced. It should be relatively easy to find the guy, couple hundred bucks should do it. Then, when you find him, you can do a "judgment debtors exam". Also, you should file an abstract of judgment with the county recorder of the county where the judgment was entered. Good luck and thanks for inquiring.

Re: writ of execution

You can look at voter registration, county recorder information, and/or do a judgment debtor exam. If the person is licensed, you can check through Sacramento.

Re: writ of execution

You can check at the county recorder's office to see if the judgment debtor owns real property; you can hire a private investigator to find bank accounts; if you know his/her address, you can serve him/her with a notice of judgment debtor's exam. You can hire a collections attorney to do all that for you, too. -Robert F. Cohen, Esq.
