Hi,
I have--name removed--I 130 petition from my mom who has appilied for me as an unmarried daughter in Feb2004. I have been checking the processing dates since 2 years ago. The dates were progressing and going forward; on june 15th on US immigration site, the processing date for my case was Nov. 8/2003 meas 3 month before my date. Today ( july 16th 2009) at 1 am , when they updated the dates, I saw that they went backward and now the date for my case is Oct 22 2001!!! Please I am too upset, this is my life and I don't know what to do. Anybody knows what sould I do? Thanks in advance.

Unfortunately you have to sit tight or explore other petition options which might be better if she becomes a U.S. citizen - depending where you're from. There are also a lot of other options as well in the area of employment or filing through possibly other family relations, etc. which I would be happy to discuss.

Do not lose hope just yet. We were worried about a similar case, and it was just approved today. If the USCIS has started processing your case, it is likely it will be processed sooner than the date that is currently stated. The processing times change month to month. Just be patient and wait until next month to see if the date changes.
The date that is posted by the USCIS is usually conservative, based on the number of applications they may have at the time they post. If your application is not processed by the time stated at the time you initially filed the application, then you should contact the USCIS to check your case status.

You should wait for your priority date to become current because you cannot do anything about this situation. Unfortunately, sometimes dates retrogress, which is what happened in your visa category this month. They will move forward again within the next several months, it could happen after October 1st.
To be able to assess your situation, an attorney would need to know much more details about your situation: your mother's status (US citizen or permanent resident), your age, your country of birth, your current residence, your current marital status, etc.

Dear Inquirer:
The priority dates in some of the preference categories sometimes "retrogress" without explanation. Essentially, this means that the State Department has allocated more visas than were available for that preference category and rolls back the priority dates to adjust. We must wait for the date to progress in months to come.
