My boyfriend was recently deported back to Mexico after living here since he was 9 years old, he is 28 now. We want to marry so that he can come back to the United States. What is the best way to go about this? How long would it take for him to be able to come back?

His visa will be initially denied by the consulate because of unlawful presence bar (10 years bar), and an extreme hardship waiver from you will be required, in addition to permission to reenter after deportation (if he was deported).
If he ever had any criminal convictions or was arrested, his situation can be even more complex.

He'll likely need two waivers, for both the removal as well as the unlawful presence he accrued while inside the US.

You have to start by getting married and filing the initial petition, then it will be the visa processing with the NVC, then the file arrives at the Consulated in Ciudad Juarez and he gets called to an interview. After the initial interview he will need to request a second interview to file a waiver (well documented) of the ten year bar to return to USA. If he is approved at the second interview he can come right back. However, why was he deported? Was he convicted of a crime? Call us at 323-549-9385
