Legal Question in Immigration Law in California
my brother is in jail facing deportation now in the next 5 days or so, he was wrongly accused, and dont have anything in record or court date. Its been more than 72 hours in jail. He came legally with a visa 5 years ago, visa expired and never went back to Mexico. He has not sign any documentation for deportation yet, should he get a lawyer to try to avoid deportation ? Never had a criminal record or problems with the law. Can someone guide us in what to do ? Time is very limited, we need help from a lawyer ASAP !! Thank you

Yes, you should definitely hire a good local immigration attorney who specializes in removal defense and can visit your brother in jail and attend hearings in Immigration Court.
It doesn't mean that a lawyer can help your brother stay in USA (if he is not eligible for any immigration benefit), but a lawyer can help to avoid deportation at least, and possibly get a grant of voluntary departure.

USCIS should not deport your brother without issuing a Notice to Appear and giving him a chance to explaine in front of an Immigrantion Judge, unless he signs voluntary departure or was convicted aggravated felony.
If your brother claims to be wrongly accused (which means he has no conviction), you should consult with an immigrant attorney to request the bond hearing or file Habeas Corpus right away.
